In the last five years or so, the US Department of Transportation has significantly stepped up pressure on states, cities, counties and other local governmental entities to comply with ADA regarding accessibility in the public right-of-way (PROW), including curb ramps, sidewalks, on-street parking, street furniture and parking meters.
Many cities believed that there was no need to make on-street parking accessible because there are no adopted guidelines. However, Federal courts have ruled that cities, universities, and other governmental entities do have to make parking and other elements in PROW accessible, even without any adopted guidelines.
We will discuss the applicability of ADA to PROW, what public entities are required to do, and the 2011 draft requirements for parking in PROW.
